Contracts after 6 June 2013

1.- DURATION OF CONTRACTS

The Urban Leasing Act (LAU) Act 29/1994, of 24 November 1994, underwent a major modification in June 2013, with the entry into force of Act 4/2013, of 4 June, on measures to make the housing rental market more flexible and more competitive, which affected the duration of the housing lease contracts, among other issues.
Therefore, Article 9 of the LAU, in its point 1, states:
The duration of the lease shall be freely agreed by the parties. If the lease is for less than three years, on expiry of the contract, it must be extended by annual instalments until the lease reaches a minimum of three years’ duration, unless the lessee declares to the lessor, at least 30 days before the termination of the contract or any of the extensions, that he or she is unwilling to renew it «.

In addition, Article 10 of the LAU, point 1, states:
If, on the expiry of the contract, or any of its extensions, at least three years after the expiration of the term of the contract, neither party has notified the other party, at least thirty days before that date, of its intention not to renew it, the contract shall necessarily be extended for a further year.

If the duration of the lease is agreed for a period of more than three years, the contract will last for the agreed period of time and when it expires, without either party informing the other of its willingness to terminate the contract, it will tacitly be renewed (*).
If the duration of the lease has been agreed for a period of three years or less, the lease shall be extended optionally for the lessor until it reaches a minimum of three years and, if the termination has not been notified, the lease shall be extended for a further year and, upon termination of the lease, it shall be tacitly renewed.

(*) The tacit reconduction is established in Art. 1566 of the Civil Code:
If, at the end of the contract, the tenant remains enjoying fifteen days of the leased property with the landlord’s consent, it is understood that there is tacit renewal for the time established in articles 1.577 and 1.581, unless it has preceded the request «.

The duration of the tacit renewal shall be as provided for in Article 1581 of the Civil Code:

Years shall be understood to have been made when an annual rent has been fixed in the original contract.
For months when a monthly rent has been fixed.
And for days when it’s every day.

1.- DURACIÓN CONTRATOS

La Ley de Arrendamiento Urbanos (LAU) Ley 29/1994, de 24 de noviembre, sufrió una importante modificación en Junio de 2013, con la entrada en vigor de la Ley 4/2013, de 4 de junio, de medidas de flexibilización y fomento del mercado del alquiler de viviendas, y que afectó entre varias cuestiones a la duración de los contratos de arrendamientos de viviendas.
Por ello, el Art. 9 de la LAU, en su punto 1º, establece:
“La duración del arrendamiento será libremente pactada por las partes. Si ésta fuera inferior a tres años, llegado el día del vencimiento del contrato, éste se prorrogará obligatoriamente por plazos anuales hasta que el arrendamiento alcance una duración mínima de tres años, salvo que el arrendatario manifieste al arrendador, con treinta días de antelación como mínimo a la fecha de terminación del contrato o de cualquiera de las prórrogas, su voluntad de no renovarlo”

Además, el Art. 10 de la LAU, en su punto 1º, establece:
 “Si llegada la fecha de vencimiento del contrato, o de cualquiera de sus prórrogas, una vez transcurridos como mínimo tres años de duración de aquel, ninguna de las partes hubiese notificado a la otra, al menos con treinta días de antelación a aquella fecha, su voluntad de no renovarlo, el contrato se prorrogará necesariamente durante un año más”.

Si la duración del arrendamiento de vivienda es pactada por un período superior a tres años, el contrato durará el tiempo que se haya pactado y llegado el vencimiento del mismo, sin que ninguna de las partes comunique de forma fehaciente a la otra su voluntad de dar por finalizado el contrato, éste entrará en tácita reconducción (*).
Si la duración del arrendamiento de vivienda se ha pactado por tiempo de tres años o inferior, el contrato se prorrogará de forma potestativa para el arrendador hasta alcanzar un mínimo de tres años y terminado este plazo, si no se ha notificado la extinción, el contrato se prorrogará por un año más, y a la finalización de éste, entrará en tácita reconducción.

(*) La tácita reconducción, viene establecida en el Art. 1566 del Código Civil:
“Si al terminar el contrato, permanece el arrendatario disfrutando quince días de la cosa arrendada con aquiescencia del arrendador, se entiende que hay tácita reconducción por el tiempo que establecen los artículos 1.577 y 1.581, a menos que haya precedido requerimiento”

La duración de la tácita reconducción será la que dispone el Art. 1581 del Código Civil:

  • Se entenderá hecho por años cuando se haya fijado un alquiler anual en el contrato primitivo.
  • Por meses cuando se haya fijado un alquiler mensual.
  • Y por días cuando sea diario.
